1. Agreement to Terms
By accessing or using ZERG3RRBOT ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
Important: This service is not affiliated with, endorsed by, or sponsored by Twitch Interactive, Inc. or Amazon.com, Inc. "Twitch" is a trademark of Twitch Interactive, Inc.
2. Eligibility
You must not be a minor to use this Service. By using the Service, you represent and warrant that you are of legal age in your jurisdiction (typically 13 years or older in the United States, 16 years or older in the European Union, or as otherwise required by applicable law).
You must have a valid Twitch account to use this Service. By logging in with Twitch, you confirm that you meet Twitch's Terms of Service requirements, including their age requirements.
If you are accessing the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Description of Service
ZERG3RRBOT provides:
- Analytics and statistics tracking for Twitch streamers and their viewers
- Leaderboards and achievement systems
- Chat-based games (trivia, hangman, etc.)
- A web dashboard for viewing statistics and managing settings
The Service operates by monitoring publicly available information from Twitch streams and chat. We do not guarantee the accuracy, completeness, or availability of the Service at all times.
4. Account Terms
Account Security
You are responsible for maintaining the security of your Twitch account. We access your account only through Twitch's official OAuth system and do not store your Twitch password. You are responsible for all activities that occur through your account on our Service.
Account Roles
Users may have different roles with different capabilities:
- Viewers: Can view their own statistics and participate in chat games
- Streamers: Can view analytics for their channel and manage settings
- Moderators: May have additional permissions as granted by streamers
5. Subscription and Payment Terms
Free and Paid Tiers
The Service offers both free and paid subscription tiers. Free tier users have access to basic features with certain limitations. Pro tier subscribers have access to additional features as described on our pricing page.
Billing
Pro subscriptions are billed monthly through Stripe or PayPal. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are listed in USD and do not include applicable taxes.
Cancellation
You may cancel your subscription at any time through your account settings or the payment provider's portal. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds are provided for partial billing periods.
Price Changes
We reserve the right to change subscription prices. We will provide at least 30 days notice before any price increase takes effect for existing subscribers.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) to access the Service without permission
- Manipulate statistics, leaderboards, or achievements through fraudulent means
- Harass, abuse, or harm other users
- Impersonate another person or entity
- Use the Service in a way that violates Twitch's Terms of Service
- Resell or redistribute access to the Service
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. You have the right to access, export, and delete your data through your Privacy Settings.
8. Intellectual Property
Our Property
The Service, including its design, features, and content (excluding user content), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.
Your Content
You retain ownership of any content you submit through the Service (such as trivia questions). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service.
Third-Party Trademarks
"Twitch" and related marks are trademarks of Twitch Interactive, Inc. All other trademarks mentioned in the Service are the property of their respective owners.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for any data loss, service interruptions, or damages arising from your use of the Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless ZERG3RRBOT, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms
- Violation of Twitch's Terms of Service
- Fraudulent or abusive behavior
- Request from law enforcement or government agency
- Discontinuation of the Service
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive (including ownership, disclaimers, indemnification, and limitations of liability).
13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator resides, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of the applicable jurisdiction, at the operator's discretion.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ZERG3RRBOT regarding the Service and supersede any prior agreements.
